This commentary addressed some ethical questions around the use of insights in capacity assessments. Based on a systematic review and meta-analysis, we considered whether and to what extent insight is appropriate as medico-legal evidence of capacity. We also provided best practice recommendations for professionals conducting assessments, when they consider insight to be potentially relevant to a person’s capacity.

We collaborated with Wayne Martin from WS4 for this commentary. His contributions to the NICE guideline on decision-making capacity were especially useful to help us understand insight within a capacity framework.
